WHILE ATTENDING EVENTS AT THE SUN VALLEY RESORT AND THE SUN VALLEY JAZZ JAMBOREE/SUN VALLEY JAZZ & MUSIC FESTIVAL PASS HOLDER AND PURCHASER WILL BE EXPOSED TO MANY PEOPLE AND THE RISK OF CONTRACTING A COMMUNICABLE DISEASE OR ILLNESS IS SERIOUS AND DANGEROUS AND MAY INVOLVE RISK OF SERIOUS ILLNESS AND/OR DEATH. HOLDER AND PURCHASER VOLUNTARILY ASSUMES ALL RISKS, HAZARDS AND DANGERS arising from or relating in any way to the risk of contracting a communicable disease or illness (including exposure to COVID-19, a bacteria, virus, or other pathogen capable of causing a communicable disease or illness), whether occurring before, during, or after the event, however caused or contracted, and hereby waives all claims and potential claims against the Sun Valley Resort, Sun Valley Jazz Jamboree/Sun Valley Jazz & Music Festival, the city of Sun Valley Idaho and Ketchum Idaho or Valley County Idaho and their officers, agents, and employees relating to such risks.
I hereby further agree to INDEMNIFY AND SAVE AND HOLD HARMLESS the Sun Valley Resort, Sun Valley Jazz Jamboree/Sun Valley Jazz & Music Festival, the city of Sun Valley Idaho and Ketchum Idaho or Valley County Idaho and each of them, and their officers, agents, and employees, from any loss, liability, damage, or cost they may incur arising out of or related to illness or death of me, my agents or employees, and/or any person or persons that I purchased a ticket for or sold to while attending or to attend an event at the Sun Valley Jazz & Music Festival whether caused by the negligence of the Sun Valley Resort, Sun Valley Jazz Jamboree/Sun Valley Jazz & Music Festival, the city of Sun Valley Idaho and Ketchum Idaho or Valley County Idaho or their officers, agents, employees, or otherwise.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY, AND UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND HAVE ELECTRONICALLY AGREED TO IT FREELY AND VOLUNTARILY WITHOUT INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY ELECTRONIC AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
